Digital Single Market: EU negotiators reach a political agreement on free flow of non-personal data
The European Parliament, Council and the European Commission tonight reached a political agreement on new rules that will allow data to be stored and processed everywhere in the EU without unjustified restrictions.
The new rules will also support the creation of a competitive data economy within the Digital Single Market.
Vice-President for the Digital Single Market Andrus Ansip said:”Data localisation restrictions are signs of protectionism for which there is no place in a single market. After free movement of people, goods, services and capital, we have made the next step with this agreement for a free flow of non-personal data to drive technological innovations and new business models and create a European data space for all types of data.”
Commissioner for Digital Economy and Society Mariya Gabriel said: “Data is the backbone of today’s digital economy and this proposal will help to build a common European data space. The European data economy can become a powerful driver for growth, create new jobs and open up new business models and innovation opportunities. With this agreement we are one step closer to completing the Digital Single Market by the end of 2018.”
The new rules will remove barriers hindering the free flow of data, and boost Europe’s economy by generating an estimated growth of up to 4% GDP by 2020.
The new free flow of non-personal data rules will:
Ensure the free flow of data across borders: The new rules set a framework for data storing and processing across the EU, prohibiting data localisation restrictions. Member States will have to communicate to the Commission any remaining or planned data localisation restrictions to the Commission in limited specific situations of public sector data processing. The Regulation on free flow of non-personal data has no impact on the application of the General Data Protection Regulation (GDPR), as it does not cover personal data. However, the two Regulations will function together to enable the free flow of any data – personal and non-personal – thus creating a single European space for data. In the case of a mixed dataset, the GDPR provision guaranteeing free flow of personal data will apply to the personal data part of the set, and the free flow of non-personal data principle will apply to the non-personal part.
Ensure data availability for regulatory control: Public authorities will be able to access data for scrutiny and supervisory control wherever it is stored or processed in the EU. Member States may sanction users that do not provide access to data stored in another Member State.
Encourage creation of codes of conduct for cloud services to facilitate switching between cloud service providers under clear deadlines. This will make the market for cloud services more flexible and the data services in the EU more affordable.
The agreed measures are in line with existing rules for the free movement and portability of personal data in the EU.
Background
The Commission presented a framework for the free flow of non-personal data in September 2017 as a part of President Jean-Claude Juncker’s State of the Union address to unlock the full potential of the European Data Economy. It was announced as one of the key actions in the mid-term review of the Digital Single Market strategy.

Microsoft showcases latest industrial IoT innovations at SPS 2017
We are excited to extend our lead in standards-based Industrie 4.0 cloud solutions using the industrial interoperability standard OPC UA, with several new product announcements at SPS IPC Drives 2017 in Nuernberg, Europe’s leading industrial automation exhibition, which takes place next week.
We continue to be the only cloud provider that offers both OPC UA client/server as well as the upcoming (in OPC UA version 1.04) Publish/Subscribe communication pattern to the cloud and back with open-source modules for easy connection to existing machines, without requiring changes to these machines and without requiring opening the on-premises firewall. We achieve this though the two Azure IoT Edge modules OPC Proxy and OPC Publisher, which are available open-source on GitHub and as Docker containers on DockerHub.
As previously announced, we have now contributed an open-source OPC UA Global Discovery Server (GDS) and Client to the OPC Foundation GitHub. This contribution now brings us close to the 4.5 million source lines of contributed code landmark, keeping us in the lead as largest contributor of open-source software to the OPC Foundation. This server can be run in a container and used for self-hosting in the OT network.
Additionally at SPS, Microsoft will demo its commercial, fully Azure IoT integrated version of the GDS and accompanying client at the OPC Foundation booth. This version runs as part of the Azure IoT Edge offering made available to the public last week.
We have continued to release monthly updates to our popular open-source Azure IoT Suite Connected Factory preconfigured solution which we launched at Hannover Messe this year. Most recently, we have updated the look and feel to be in line with the new set of preconfigured solutions currently being released. We will continue to release new versions of the Connected Factory on a monthly basis with improvements and new features, so check them out on a regular basis.
Our OPC UA Gateway program also keeps growing rapidly. Since we launched the program just six months ago at Hannover Messe, we now have 13 partners signed up including Softing, Unified Automation, Hewlett Packard Enterprise, Kepware, Cisco, Beckhoff, Moxa, Advantech, Nexcom, Prosys OPC, MatrikonOPC, Kontron, and Hilscher.
Furthermore, we are excited to announce that the Industrial IoT Starter Kit, previously announced at OPC Day Europe, is now available to order online from our partner Softing. The kit empowers companies to securely link their production line from the physical factory floor to the Microsoft Azure IoT Suite Connected Factory in less than one day. This enables the management, collection, and analysis of OPC UA telemetry data in a centralized way to gain valuable business insights immediately and improve operational efficiency. End of Roaming Charges in the EU
Roaming charges in the European Union will no longer apply. President of the European Parliament Antonio Tajani, Prime Minister of Malta Joseph Muscat, on behalf of the Maltese Presidency of the Council of the European Union, and President of the European Commission Jean-Claude Juncker, issued the following statement:
“The European Union is about bringing people together and making their lives easier. The end of roaming charges is a true European success story.
From now on, citizens who travel within the EU will be able to call, text and connect on their mobile devices at the same price as they pay at home. Eliminating roaming charges is one of the greatest and most tangible successes of the EU.
Over the last 10 years, our institutions have been working hard together to fix this market failure. Each time a European citizen crossed an EU border, be it for holidays, work, studies or just for a day, they had to worry about using their mobile phones and a high phone bill from the roaming charges when they came home. Roaming charges will now be a thing of the past. As of tomorrow, you will be able to remain connected while travelling in the EU, for the same price as at home.
It has been a long time coming, with many actors involved. By working closely together, the European Union has delivered a concrete, positive result for European citizens. We are proud that the EU has put an end to very high roaming prices and thankful to those who showed the determination to overcome the many challenges and pursue this goal.
At the same time, the EU has managed to find the right balance between the end of roaming charges and the need to keep domestic mobile packages competitive and attractive. Operators have had 2 years to prepare for the end of roaming charges, and we are confident that they will seize the opportunities the new rules bring to the benefit of their customers.
The end of roaming charges is at the foundation of the EU’s Digital Single Market and is another step towards building a united and sustainable European digital society, accessible for all our citizens.”

This cooperation agreement will foster collaboration across multiple fronts in the development of biopharmaceutical capabilities in the Kingdom, stressing on the importance of vaccine research and the development of local capabilities, eventually leading to the initiation of a bio-science park.]
The sustainability of the multiple partnerships hinges on a critical component – an active and engaged workforce delivering on the limitless potential evident. The MoU with the Small and Media Enterprises Authority [SMEA] in Saudi serves to highlight the entrenched commitment to capability enhancement in GE’s business in the Kingdom. Through the training and development of thousands of Saudi nationals, and the offering of thousands more job opportunities, the agreements are a crucial element of the long-term sustainability of local industry.
Hisham Bahkali, President and CEO Saudi Arabia and Bahrain, GE, said: “While the scale of projects and numbers announced today are truly remarkable, perhaps the greatest benefit will come from the impact on people. Saudi Vision 2030 is very clear: a strong and empowered local workforce is a must to realize the potential and long-term viability of the vision. These projects will not only create thousands of job opportunities in the Kingdom, but will also see the training, development and upskilling of thousands more Saudi men and women. Our MoU with SMEA is a prime indicator of the exceptional potential evident within all facets of the business community, and the many opportunities that will be available through the development of the local supplier ecosystem. The agreements we sign today are vital to the stimulation of the work force, and we are thrilled to be a part of them.”

Three Challenges For The Web, According To Its Inventor – Sir Tim Berners-Lee
I imagined the web as an open platform that would allow everyone, everywhere to share information, access opportunities and collaborate across geographic and cultural boundaries. In many ways, the web has lived up to this vision, though it has been a recurring battle to keep it open. But over the past 12 months, I’ve become increasingly worried about three new trends, which I believe we must tackle in order for the web to fulfill its true potential as a tool which serves all of humanity.
1) We’ve lost control of our personal data
The current business model for many websites offers free content in exchange for personal data. Many of us agree to this – albeit often by accepting long and confusing terms and conditions documents – but fundamentally we do not mind some information being collected in exchange for free services. But, we’re missing a trick. As our data is then held in proprietary silos, out of sight to us, we lose out on the benefits we could realise if we had direct control over this data, and chose when and with whom to share it. What’s more, we often do not have any way of feeding back to companies what data we’d rather not share – especially with third parties – the T&Cs are all or nothing.
This widespread data collection by companies also has other impacts. Through collaboration with – or coercion of – companies, governments are also increasingly watching our every move online, and passing extreme laws that trample on our rights to privacy. In repressive regimes, it’s easy to see the harm that can be caused – bloggers can be arrested or killed, and political opponents can be monitored. But even in countries where we believe governments have citizens’ best interests at heart, watching everyone, all the time is simply going too far. It creates a chilling effect on free speech and stops the web from being used as a space to explore important topics, like sensitive health issues, sexuality or religion.
2) It’s too easy for misinformation to spread on the web
Today, most people find news and information on the web through just a handful of social media sites and search engines. These sites make more money when we click on the links they show us. And, they choose what to show us based on algorithms which learn from our personal data that they are constantly harvesting. The net result is that these sites show us content they think we’ll click on – meaning that misinformation, or ‘fake news’, which is surprising, shocking, or designed to appeal to our biases can spread like wildfire. And through the use of data science and armies of bots, those with bad intentions can game the system to spread misinformation for financial or political gain.
3) Political advertising online needs transparency and understanding
Political advertising online has rapidly become a sophisticated industry. The fact that most people get their information from just a few platforms and the increasing sophistication of algorithms drawing upon rich pools of personal data, means that political campaigns are now building individual adverts targeted directly at users. One source suggests that in the 2016 US election, as many as 50,000 variations of adverts were being served every single day on Facebook, a near-impossible situation to monitor. And there are suggestions that some political adverts – in the US and around the world – are being used in unethical ways – to point voters to fake news sites, for instance, or to keep others away from the polls. Targeted advertising allows a campaign to say completely different, possibly conflicting things to different groups. Is that democratic?
These are complex problems, and the solutions will not be simple. But a few broad paths to progress are already clear. We must work together with web companies to strike a balance that puts a fair level of data control back in the hands of people, including the development of new technology like personal “data pods” if needed and exploring alternative revenue models like subscriptions and micropayments. We must fight against government over-reach in surveillance laws, including through the courts if necessary. We must push back against misinformation by encouraging gatekeepers such as Google and Facebook to continue their efforts to combat the problem, while avoiding the creation of any central bodies to decide what is “true” or not. We need more algorithmic transparency to understand how important decisions that affect our lives are being made, and perhaps a set of common principles to be followed. We urgently need to close the “internet blind spot” in the regulation of political campaigning.
Our team at the Web Foundation will be working on many of these issues as part of our new five year strategy – researching the problems in more detail, coming up with proactive policy solutions and bringing together coalitions to drive progress towards a web that gives equal power and opportunity to all. I urge you to support our work however you can – by spreading the word, keeping up pressure on companies and governments or by making a donation. We’ve also compiled a directory of other digital rights organisations around the world for you to explore and consider supporting too.
I may have invented the web, but all of you have helped to create what it is today. All the blogs, posts, tweets, photos, videos, applications, web pages and more represent the contributions of millions of you around the world building our online community. All kinds of people have helped, from politicians fighting to keep the web open, standards organisations like W3C enhancing the power, accessibility and security of the technology, and people who have protested in the streets. In the past year, we have seen Nigerians stand up to a social media bill that would have hampered free expression online, popular outcry and protests at regional internet shutdowns in Cameroon and great public support for net neutrality in both India and the European Union.
It has taken all of us to build the web we have, and now it is up to all of us to build the web we want – for everyone. If you would like to be more involved, then do join our mailing list, do contribute to us, do join or donate to any of the organisations which are working on these issues around the world.
Sir Tim Berners-Lee
The Web Foundation is at the forefront of the fight to advance and protect the web for everyone. We believe doing so is essential to reverse growing inequality and empower citizens. Samsung Global Innovation Center (GIC) Rebrands to Samsung NEXT
Samsung has always strived to inspire the world and drive innovation for the future, and the Samsung Global Innovation Center (GIC) has served as a key catalyst for these efforts ever since its inception in 2013. At the Consumer Electronics Show (CES) in January 2017, Samsung announced the rebrand of GIC as Samsung NEXT.
Samsung NEXT first began as a small operation with a mission to create breakout software and services and foster a startup culture at Samsung. Deeply rooted in startup ecosystems around the world, Samsung NEXT has evolved into a global organization of entrepreneurs, engineers, investors, strategists and business development leaders all working to realize its vision in close partnership with innovators everywhere.
“Since we started, our focus has been on identifying talented entrepreneurs and accelerating their development into groundbreaking startups — whether in Silicon Valley, New York, Tel Aviv or beyond,” said David Eun, President of Samsung NEXT. “In addition to capital and access to diverse expertise, we provide a proven pathway to Samsung’s global reach of consumer electronics, partners and vast resources. The best innovators deserve and will increasingly require this type of specialized support to create leading software and services now and in the future.”
Continuing its dedication to entrepreneurs and startups, Samsung NEXT will partner with tech innovators around the world and empower them with the tools and resources they need for accelerated business growth and success. In addition to funding and resources along with workspaces and domain expertise, Samsung NEXT’s support includes growth opportunities, mergers and acquisitions and partnerships to enrich consumer experiences across Samsung’s increasingly connected displays and devices.
A Rebrand Focused on Clarity of Vision
Taking a key step in line with its vision, Samsung NEXT also announced at CES the creation of the Samsung NEXT Fund, a $150 million venture capital investment fund, to increase Samsung’s global support of early stage startups pursuing advanced software and services innovation.
To coincide with the launch of the Fund, Samsung NEXT unveiled its rebrand – to simplify its identity and clarify its vision – with the release of a new logo and website.
“The new name resonates with our passion and dedication for partnering with tech innovators to take them to the NEXT level,” explained Sayo Martin, Head of Marketing at Samsung NEXT. “The new logo—represented by an arrow (symbolizing innovation) moving forward through open gates (Samsung)—reflects our mission to turn great ideas into products, grow products into thriving businesses, and scale businesses that leverage and transform the Samsung ecosystem.”
What’s Next for Samsung NEXT?
Samsung NEXT has completed over 50 investments, 15 of which are new investments made under the Samsung NEXT Fund. It will continue to expand in its support for tech innovators around the world across the areas of VR, Connected Cars/Autonomous Driving, Security, Artificial Intelligence, IoT, Mobile Commerce and other new frontier technologies.
“Leading tech entrepreneurs have a genuine passion for tackling complex problems with incredible speed and agility,” said Eun. “For Samsung to continue evolving and innovating, we believe integrating the best of startup culture into our cultural DNA is essential.”
Merger of Vodafone India and Idea: Creating The Largest Telecoms Operator In India
Vodafone to combine its subsidiary Vodafone India (excluding its 42% stake in Indus Towers) with Idea, which is listed on the Indian Stock Exchanges.
Highly complementary combination will create India’s largest telecoms operator1 with the country’s widest mobile network and a strong commitment to deliver the Indian government’s ‘Digital India’ vision.
Sustained investment by the combined entity will accelerate the pan-India expansion of wireless broadband services using 4G/4G+/5G technologies, support the introduction of digital content and ‘Internet of Things’ (IoT) services as well as expand financial inclusion through mobile money services for the benefit of Indian consumers, businesses and society as a whole.
Merger of equals with joint control of the combined company between Vodafone and the Aditya Birla Group, governed by a shareholders’ agreement.
The merger ratio is consistent with recommendations from the joint independent valuers. The implied enterprise value is INR828 billion (US$12.4 billion) for Vodafone India and INR722 billion (US$10.8 billion) for Idea excluding its stake in Indus Towers, valuing Vodafone India at 6.4x EV/LTM EBITDA and Idea excluding its stake in Indus Towers at 6.3x EV/LTM EBITDA2.
Substantial cost and capex synergies with an estimated net present value of approximately INR670 billion (US$10.0 billion) after integration costs and spectrum liberalisation payments, with estimated run-rate savings of INR140 billion (US$2.1 billion) on an annual basis by the fourth full year post completion3.
Vodafone will own 45.1% of the combined company after transferring a stake of 4.9% to the Aditya Birla Group for circa INR39 billion (circa US$579 million) in cash concurrent with completion of the merger. The Aditya Birla Group will then own 26.0% and has the right to acquire more shares from Vodafone under an agreed mechanism with a view to equalising the shareholdings over time.
If Vodafone and the Aditya Birla Group’s shareholdings in the combined company are not equal after four years, Vodafone will sell down shares in the combined company to equalise its shareholding to that of the Aditya Birla Group over the following five-year period.
Until equalisation is achieved, the voting rights of the additional shares held by Vodafone will be restricted and votes will be exercised jointly under the terms of the shareholders’ agreement.
Vodafone India will be deconsolidated by Vodafone on announcement and reported as a joint venture post- closing, reducing Vodafone Group net debt by approximately INR552 billion (US$8.2 billion) and lowering Vodafone Group leverage by around 0.3x Net Debt/EBITDA4. The transaction is expected to be accretive to Vodafone’s cash flow5 from the first full year post-completion.
The transaction is expected to close during calendar year 2018, subject to customary approvals.
Aditya Birla Group Chairman, Kumar Mangalam Birla, said:
“Throughout its history, the Aditya Birla Group has been synonymous with the task of nation building and driving inclusive growth in the country. This landmark combination will enable the Aditya Birla Group to create a high quality digital infrastructure that will transition the Indian population towards a digital lifestyle and make the Government’s Digital India vision a reality. For Idea shareholders and lenders who have supported us thus far, this transaction is highly accretive, and Idea and Vodafone will together create a very valuable company given our complementary strengths.”
Vodafone Group Plc Chief Executive, Vittorio Colao said:
“The combination of Vodafone India and Idea will create a new champion of Digital India founded with a long-term commitment and vision to bring world-class 4G networks to villages, towns and cities across India. The combined company will have the scale required to ensure sustainable consumer choice in a competitive market and to expand new technologies – such as mobile money services – that have the potential to transform daily life for every Indian. We look forward to working with the Aditya Birla Group to create value for all stakeholders.”
